These Terms govern your use of our online store at shop.asymmetrichealth.com and any purchase you make here. They cover two things: how you may use this site, and how buying from it works.
By visiting this site you agree to these Terms. By placing an order you also agree to our Store Shipping Policy, Store Returns & Refund Policy and Store Privacy Policy, each of which is part of these Terms.
If you don't agree, don't use this site.
The store is operated by Asymmetric Health, PLLC, 8282 28th Ct NE, Suite C, Lacey, WA 98516.
What These Terms Do Not Cover
Our clinical practice website at www.asymmetrichealth.com is governed by its own Terms & Conditions and its own privacy documents. Those documents govern the practice and the care it delivers. These Terms govern this store. Neither set reaches the other.
Our Consumer Health Data Privacy Policy is the one document that spans both. It covers consumer health data collected through asymmetrichealth.com and shop.asymmetrichealth.com, and it lives on the practice website.
Part One: Using This Site
Eligibility
You must be at least 18 years of age to use this site or purchase from it.
We ship only sharps to addresses in Washington State.
No Prescription Medications Are Sold Here
This store sells non-prescription goods only. No medication of any kind is sold, dispensed or shipped through this store.
We are not a pharmacy.
Prescriptions written by Asymmetric Health providers are filled by independent licensed pharmacies and are handled entirely through our clinical practice. Nothing on this store can be purchased in place of a prescription, and nothing purchased here requires one.
Using This Site Is Not Medical Care
Visiting this site or buying from it does not make you a patient of Asymmetric Health, does not create a provider-patient relationship, and does not entitle you to clinical services.
Product descriptions and any instructional material we provide are general information. They're not medical advice and they don't replace evaluation by a licensed provider. If you have a question about whether a product is appropriate for you, ask your own provider.
Store Accounts
You may check out as a guest. If you create an account, you're responsible for the accuracy of the information you give us and for keeping your login credentials private.
Tell us right away if you believe someone else has used your account. You're responsible for activity under your account until you do.
We may suspend or close an account at our discretion, including for any of the conduct described below.
Acceptable Use
Don't do any of the following on this site:
Buy for resale, or buy on behalf of someone else without telling us.
Give false information, including a false name, age, address or intended use.
Try to get around our shipping restrictions, quantity limits or access controls.
Use bots, scrapers, crawlers or automated tools to access the site or place orders.
Interfere with the site's operation, probe it for vulnerabilities, or attempt unauthorized access to any part of it.
Copy, republish or resell site content.
Use the site for any unlawful purpose.
We may cancel orders, close accounts and refuse further service for any of these, without notice and without giving a reason.
Site Content and Intellectual Property
Store content, including text, images, product descriptions and layout, is the property of Asymmetric Health or its licensors and may not be reproduced or distributed without written permission. Manufacturer names, logos and product images remain the property of their owners.
Site Availability
We don't promise the site will be available without interruption or free of errors. We may change, suspend or discontinue any part of it, including any product, at any time and without notice.
Links to Other Sites
This site links to sites we don't operate, including our practice website, our patient portal and manufacturer pages. We're not responsible for their content or their privacy practices.
Part Two: Buying From This Site
Injection Supplies
Sterile syringes, needles and related injection supplies are regulated differently from state to state. Some states restrict who may buy them, cap how many may be sold at one time, or require a prescription. We ship these items to Washington addresses only.
Washington law requires a retailer selling a hypodermic syringe or needle to be satisfied that the device will be used for its intended legal purpose. When you order injection supplies from this store you confirm that you are buying them for lawful personal medical use. Don't order them for any other reason.
We may limit quantities, decline an order, or cancel an order after it's placed. We may decline without giving a reason.
Do not resell products purchased from this store.
Used needles and syringes are regulated waste. Place them in a rigid sharps container immediately after use and dispose of the container through a program approved in your area. Never put loose sharps in household trash or recycling.
Specialty Test Kits
Certain laboratory test kits are sold through this store and are not listed publicly. Where we send you a direct link to purchase one, that purchase is a retail sale on this store and is governed by these Terms.
We sell you a boxed kit. That's the whole transaction. You register the kit with the laboratory, collect the sample at home, and mail it to the laboratory yourself. We don't send the laboratory your name, your order, or anything else about you.
The test is performed by an independent laboratory under its own terms and its own obligations for handling health information. Your relationship for the test itself is with that laboratory.
A test result is not a diagnosis.
Dietary Supplements
We sell a limited selection of dietary supplements directly through this store. We are the seller, we set the price, and we earn a margin on the sale.
You're never required to buy a supplement from us. The same or comparable products are available from other retailers, and your medical care doesn't depend on where you buy them.
Dietary supplements are not reviewed or approved by the FDA before they're sold. Any statement on this store about what a supplement does has not been evaluated by the Food and Drug Administration, and no supplement sold here is intended to diagnose, treat, cure or prevent any disease.
Talk to your provider before starting a supplement, particularly if you're pregnant or nursing, take prescription medication, or have a medical condition. Supplements interact with medications.
Prices, Availability and Product Information
All prices are in U.S. dollars. Sales tax is calculated at checkout based on your shipping address. Shipping cost is shown before you complete your order.
We try to describe products accurately. Descriptions, images, specifications and prices can contain errors and can change without notice. Where a product is listed at an incorrect price or with a materially incorrect description, we may cancel the order and refund you in full, whether or not the order has been confirmed.
Product availability is not guaranteed. Where an item is out of stock after you order, we'll tell you and refund that item.
Orders and Acceptance
Your order is an offer to buy. We accept it when we ship the item, not when you place it and not when you receive an order confirmation email.
We may refuse, limit or cancel any order at our discretion, including orders that appear to be for resale, orders with quantities inconsistent with personal use, orders we can't verify, and orders to a shipping address outside our shipping area.
If we cancel an order you've paid for, we refund the full amount to the original payment method.
Payment
Payments are processed by Bankful, our store payment processor. We don't see or store your full payment card number.
All purchases are one-time. This store has no subscriptions, no recurring charges and no automatic renewals. Nothing you buy here will bill you again.
Charges appear on your statement as Asymmetric Health.
If a charge doesn't look right, contact us before you dispute it with your bank. We resolve most of these the same day.
Shipping, Returns and Refunds
Where we ship, what it costs and how long it takes are covered by our Store Shipping Policy. Returns, refunds, cancellations and what can't be returned are covered by our Store Returns & Refund Policy. Both are part of these Terms.
Where these Terms and either of those policies conflict, these Terms control.
Product Safety and Adverse Events
Follow the manufacturer's instructions for every product you buy. Don't use a product that arrives damaged, opened, or with compromised packaging.
If you experience an injury or a reaction connected to a product purchased here, stop using it and contact us at [email protected]. If you're having a medical emergency, call 911 or go to the nearest emergency department. This store and that email address are not monitored for emergencies.
Adverse events involving FDA-regulated drugs and devices may also be reported to the FDA MedWatch program at www.fda.gov/medwatch or 1-800-FDA-1088.
Part Three: General Terms
Disclaimer
Products are sold as they come from the manufacturer, with whatever warranty the manufacturer provides. To the maximum extent permitted by law, we make no warranty of our own, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.
Nothing in this section limits any warranty that cannot be disclaimed under Washington law.
Limitation of Liability
To the maximum extent permitted by law, Asymmetric Health is not liable for any indirect, incidental, special or consequential damages arising from or related to your use of this store or any product purchased here. Our total liability for any order is limited to the amount you paid for that order.
Nothing in these Terms limits liability that cannot be limited under Washington law. Nothing in these Terms limits or waives any right or remedy you have arising from the provision of professional health care services by Asymmetric Health.
Indemnification
You agree to reimburse us for any claim, loss or expense arising from your misuse of this site, your violation of these Terms, or your unlawful use of a product bought here. This doesn't apply to anything caused by our own conduct.
Electronic Communications
Placing an order means you agree to receive order confirmations, shipping notices and other transaction messages by email. Those aren't marketing and you can't opt out of them while an order is open. Marketing email is separate and every message carries an unsubscribe link.
Changes to These Terms
We may update these Terms. Changes take effect when posted and the effective date above will be revised. The Terms in force when you place an order govern that order.
Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Venue for any dispute arising under these Terms lies in Thurston County, Washington.
This section applies to these Terms only. It does not apply to our Notice of Privacy Practices, to our Consumer Health Data Privacy Policy, or to any right you have under HIPAA, chapter 70.02 RCW or chapter 19.373 RCW.
Severability
If any part of these Terms is found unenforceable, the rest stays in force and the unenforceable part is limited to the minimum extent necessary.
Waiver and Assignment
Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms. We may assign them in connection with a sale or reorganization of the business.
Entire Agreement
These Terms, together with our Store Shipping Policy, Store Returns & Refund Policy and Store Privacy Policy, are the entire agreement between you and us regarding this store.
They don't replace or modify any agreement you have with Asymmetric Health as a patient, including our practice Terms & Conditions, our membership agreement, or any consent form you've signed.
